Career Mentorz  (U/o Mustard Collective Private Limited) – Terms of Service

 Governing Jurisdiction: Karnataka, India

1. Applicable Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, specifically the state of Karnataka.

Any disputes shall be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka.

2. Limitation of Liability (India Compliant)

2.1 No Guaranteed Outcomes

Career MentorZ provides mentorship services but does not guarantee employment, salary hikes, or career success. Mentors are independent advisors, and their advice is not legally binding.

2.2 Liability Cap

Our total liability for any claims (including negligence) shall not exceed the fees paid by you in the last 6 months or INR 10,000 (whichever is lower).

We are not liable for:

Indirect damages (lost opportunities, reputational harm).

Acts/omissions of mentors or third parties (e.g., payment gateways).

Technical failures (server crashes, data breaches beyond reasonable security measures).

2.3 Exceptions

This clause does not affect:

Liability for death/personal injury due to our negligence.

Rights under the Indian Consumer Protection Act 2019 (e.g., defective services).

Fraud or willful misconduct by Career MentorZ.

3. Consumer Protection & Grievances

Users may file complaints via:

Written notice to our registered office (include address in Karnataka).

Redressal: Complaints will be resolved per Karnataka state consumer forum procedures.

4. Data Protection (India DPDPA 2023)

By using our services, you consent to data processing under our Privacy Policy, compliant with India’s Digital Personal Data Protection Act (DPDPA) 2023.

Users may request data correction/deletion via privacy@careermentorz.com.

5. Payment & Refunds

All fees are in INR and inclusive of GST (if applicable).

Refunds processed within 7–14 working days, subject to:

Mentor cancellations: Full refund.

User cancellations: As per our Cancellation Policy.

6. Amendments

Changes to these Terms will be notified via email/Platform. Continued use constitutes acceptance.

7. Force Majeure

We are not liable for delays/failures caused by events beyond our control (e.g., natural disasters, govt. orders).

8. Arbitration Clause

8.1 Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms, including breach or termination, shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

Court litigation is waived, except for interim relief (e.g., injunctions).

8.2 Arbitration Rules

Arbitration shall be conducted by a sole arbitrator appointed jointly by both parties.

If parties cannot agree, the arbitrator shall be appointed by the Bengaluru Centre for Alternative Dispute Resolution (CADR) or as per the Act.

The seat of arbitration shall be Bengaluru, Karnataka. The proceedings shall be in English.

8.3 Process

Arbitration must be initiated within 1 year of the dispute arising (failure waives the claim). The arbitrator’s award shall be final and binding, enforceable in Karnataka courts.

8.4 Costs

Each party bears its own legal fees.

Arbitration costs (arbitrator fees, administrative expenses) shall be shared equally unless the award specifies otherwise.

8.5 Exceptions

Either party may seek urgent relief in Karnataka courts for:

Intellectual property infringement.

Unauthorized data access.
